GENERAL CONDITIONS OF USE

1. DEFINITIONS

Each word starting with a capital letter takes the meaning as given to it by the definitions in this Article.
"Conditions of Use": Means this document.
"Special Conditions": Means the Specific details and conditions of use for certain individual Services.
"Services": Means all the services for Users provided by La Poste, accessible through the www.laposte.fr. portal.
"Users": Means any natural person who uses one or more of the Services.

2. PURPOSE

This document forms the Conditions of Use for the Services. The purpose of this document is to define the applicable details and Conditions of Use for the Services for the User. Any use of the Services is subject to full compliance with these Conditions of Use such as stated in the following Article.

3. HIERARCHY, ACCEPTANCE AND MODIFICATION

3.1 Hierarchy

La Poste supplies the Services subject to these Conditions of Use. Certain Services are subject to their own specific conditions of use (the Special Conditions) which are in addition to the Conditions of Use. The Special Conditions are an integral part of the Conditions of Use. If the terms, conditions and details of the Conditions of Use are in contradiction with the Special Conditions, these Conditions of Use shall prevail.

3.2 Acceptance

La Poste provides its Services for you subject to your agreement to comply with these Conditions of Use. We recommend that you regularly check the latest version of the Conditions of Use. By using the Services you are deemed to have agreed and accepted the Conditions of Use. Any use of the Services implies acceptance of the Conditions of Use as stated in their most recent version.

3.3 Modification

The Conditions of Use can be modified at any time by La Poste. The modified Conditions of Use will then enter into effect as of the instant they are put online. We recommend that the User reads the Conditions of Use regularly. The User is deemed to have accepted the latest version with each new connection to the Services.

4. REGISTRATION FOR SERVICES

For the use of certain of the Services you must complete a registration form and supply details about yourself. You agree to provide accurate, full and current details. In the event of the information you provide being inaccurate, incomplete or out of date, La Poste will take all measures it deems appropriate to suspend your access to the service in question, whether permanently or temporarily.

5. PERSONAL DATA

The User expressly agrees that data of a personal nature collected during the registration procedures for certain of the Services can only be used for the purposes of these Services. In application of the provisions of the French Freedom and information act (Loi Informatique et Libertés) of 6 January 1978, La Poste will only use the data of a personal nature on the User for the sole purposes as stated above. La Poste expressly agrees not to process this in any way that is incompatible with the purpose of the Services, or to disclose, divulge or forward the information concerning the User, without the user’s prior agreement.
Pursuant to the provisions of the French Freedom and information act (Loi Informatique et Libertés) of 6 January 1978, you have a right to access, correct and remove data of a personal nature relating to you, this right can be exercised at the following address: infospersonnelles.lapostefr@laposte.net
La Poste certifies that data of a personal nature will not be transferred to third parties. This guarantee does not apply to processing for statistical purposes or historic or scientific research, notably in the context of sociological or scientific studies, when the processing only makes use of the data in an anonymous and generalised form.
La Poste will implement suitable technical and organisational measures to protect all data of a personal nature against accidental or illegal destruction, it’s accidental loss, alteration, distribution and unauthorised access.
La Poste will keep the data of a personal nature for a period of time not exceeding that required for the completion of the purpose for which it was collected or processed.
La Poste may be required to disclose information relating to you in compliance with current legislation or regulations, or in response to a Court or administrative order.
La Poste cautions that you take the utmost care concerning the distribution of data about you, when using communication Services (email, chat, forum), because data distributed in this manner can be accessed and used by third parties unknown to you.

6. COOKIES

La Poste reserves the right to use cookies in order to ensure the optimum management of the Services, to improve your browsing for the Services and to compile statistics. If you so wish you can reject cookies by changing the settings for your browser, in most cases in its ’Preferences’ menu.

7. LOGIN AND PASSWORD

To access some of the Services you will need to use a login and a password. Your password is personnel and confidential. You agree not to disclose these to any third party in whatever form and for whatever reason and to immediately inform La Poste of any unauthorised use by a third party and of any threat to security that could arise. You are solely responsible for keeping your password safe and for any use of it that may be made.

8. CHANGES TO THE SERVICES

La Poste reserves the right to change or to temporarily or permanent suspend all or some of the Services, without prior notice to the User.

9. COST OF ACCESSING THE SERVICES

Most of the Services can be accessed through the Internet and by using other means of communication for some of these. The cost of connecting to the Services is the responsibility of the User.

10. USE OF THE SERVICES BY MINORS

If the User is a minor, the User declares that authorisation to use the Services has been obtained from the relevant holder(s) of parental authority and that the holder(s) of the parental authority have agreed to guarantee the compliance of the minor User with the Conditions of Use. Any use of the Services by a Minor User is subject to the entire responsibility of the holder(s) of the parental authority relating to the User in question.

11. USE OF THE SERVICES BY THE USER

You agree to use the Services in accordance with national and international regulations, and in particular not to use them to display, download, send, transmit any content: of a violent nature or likely to interfere with the respect and the dignity of human beings, equality between men and women, the protection of children and adolescents, notably with the compilation, transmission and distribution of messages of a violent or pornographic character or nature likely to negate human dignity; that encourage the commission of crimes and misdemeanours; that encourage the consumption of illegal substances; that incite or could incite discrimination, hatred, or violence on the grounds of race, ethnic or national origin; that are illegal, injurious, threatening, abusive, constitute harassment, are defamatory, harmful, vulgar, obscene, contrary to the privacy of others or that could offend the sensibilities of some people; that mislead other Users by usurping the name or company name of others; that interfere with the rights of third parties such as, without this list being limiting, any manufacturing secret, industrial secret, confidential information, brand, patent and in general any industrial or intellectual right or any other right relating to protected information or content; including, without this list being limiting, computer viruses and any other code or program, designed to interfere, destroy or limit the functionality or any software, computer or telecommunications equipment.
You agree to:
- Regularly refer to the Conditions of Use and to comply with these; not to collect and/or store data of a personal nature belonging to other Users; not to harass in any manner one or more other Users; not to interfere or disrupt the operation of the Services.

12. ACCESS RESTRICTIONS

In the event of your failure to comply with any of these Conditions of Use, access to the Services will automatically be blocked, without prejudice to any legal action that may be taken by La Poste and any damages that may be payable by you.

13. LINKS

The Services may contain links to the sites of the partners of La Poste or third parties. La Poste does not have any control over these sites and does not therefore accept any liability concerning the availability of these sites, the content, advertising, products or services available on or through these sites.

14. RELATIONS WITH PARTNERS AND ADVERTISERS

Any commercial relations of any sort that you may establish when using the Services, with the partners of La Poste or advertisers present in the Services, are directly with the partners and/or the advertisers and La Poste is not a party to these dealings. As a result therefore La Poste cannot be held liable for any loss suffered by the User through the User’s relations with the partners of La Poste or the advertisers.

15. INTELLECTUAL PROPERTY RIGHTS

The contents, namely texts, software, audio documents, photographs and drawings that are shown or are available on the Services, are protected by intellectual property rights and are the exclusive property of La Poste and/or its partners as appropriate. You therefore agree, without this list being limiting, not to use, reproduce, represent, distribute, adapt or borrow the contents of the Services protected by intellectual property rights, without the express authorisation of La Poste and/or its partners.

16. TRADEMARKS/BRANDS

The trademarks that are displayed on the Services are protected trademarks of La Poste and/or of its partners. Any reproduction or use of these trademarks without the express authorisation of La Poste and/or of its partners is strictly forbidden.

17. GUARANTEE

You agree to guarantee La Poste against any actions that may be taken against it, or any claims that may be made against it, by a third party, as a result of your use or through the use of your login and your password, of the Services under conditions that do not comply with the Conditions of Use. This guarantee covers all monies that La Poste may be required to pay on whatever grounds, including legal fees and court costs for conviction or ordered, within a reasonable limit. There are no guarantees concerning the use of the Services. La Poste does not make any explicit or implied guarantee concerning the use of the Services by the User and namely concerning the availability, the suitable, current, reliable or useful nature of the Services and their contents.
Furthermore, La Poste does not guarantee that the contents and services obtained by the User on the Services will satisfy the User’s expectation, or that the contents and services supplied comply with all regulations or third party rights.

18. LIMITATION OF LIABILITY

You are responsible for the use of your login and your password. Any connection to the Services and transmission of data performed using your login and your password will be deemed to have been made by you. These provisions remain applicable including if you have saved your login and your password on your microcomputer, thereby allowing automatic connection to the Services. The User hereby accepts the characteristics and the limits of the Internet and in particular acknowledges being aware of the nature of the Internet network and in particular of its technical features.
La Poste cannot be held liable in any way for, and without this list being limiting, changes to, the suspension or the interruption of the Services. La Poste cannot be held liable for the reliability of data transmission, access times, any restrictions on access to the Internet or the networks to which it is connected. La Poste cannot be held liable in the event of the interruption to the access networks to the Services, the total or partial non-availability of the Services attributable notably to the telecommunications operator, in the event of transmission errors or problems relating to the security of transmissions, in the event of the failure of receiving equipment or your telephone line. La Poste may suspend its Services for the purpose of maintenance. Notice of this suspension will be given by means of a warning shown on the home page or by any other means. La Poste cannot be held liable in any way as a result of such a suspension nor does it give rise to any right to compensation.
La Poste cannot under any circumstance be held liable for any direct damages and notably any commercial, moral and/or financial prejudice and including any loss of earnings caused by, originating in or arising from the use of the Services or their contents.
La Poste does not accept any liability concerning the use of the Services or their contents. The contents and services supplied by the partners of La Poste through the Services are subject to the exclusive responsibility of the partners of La Poste. La Poste does not therefore accept any liability for direct or indirect damages, occurring notably during access by the User to the Services or the use of the Services, the non-compliance of the Services or their contents with any regulations or any infringement of the rights of a third party.
You are solely responsible for all content (notably texts, images or sounds) that you communicate to any third party by means of one of the Services, whether sent in a public or private context. La Poste cannot therefore be held liable for any contents communicated by the Users using the Services.

19. SUNDRY PROVISIONS

If any of these clauses is found to be null and void, it shall be considered as not having been written and shall not result in the invalidity of the other clauses. If La Poste does not enforce any of the rights as arising under these Conditions of Use this shall not be deemed as being an abandoning of its rights.

20. APPLICABLE LAW - ASSIGNMENT OF JURISDICTION

Any dispute arising from the interpretation and/or the execution of these Conditions of Use must be the object of an attempt at an amicable settlement. If an amicable settlement cannot be reached, the dispute will be subject to the laws of France and submitted to the relevant Court within the jurisdiction of the Cour d’Appel de Paris ruling in accordance with the laws of France.
